Shipping Policy

 

1. Shipping: After your order has been added to our “Shopping Cart,” it will be shipped via FedEx within 1-2 business days.

2. Shipping & handling charges: are displayed after an item has been added to the “Shopping Cart.” These shipping charges are applicable ONLY to orders within the continental US. Please call our customer service department at 718-675-0706 for shipping rates to Hawaii, Alaska, and the US Territories, and for international orders.

3. Deadline for ordering: If an order is placed before 12:00 PM EST, Monday through Thursday, it will arrive within 1-2 business days. All orders placed after Thursday 12:00 PM EST, will arrive the following Tuesday or Wednesday. Please note: NO orders are processed or shipped on weekend days. Because of shipping limitations, we cannot ship packages for delivery on the following holidays, and the day immediately following each holiday: New Year’s Day, President’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas.

4. Saturday delivery is available: For Next Day Delivery only and an additional delivery fee will apply. To ensure Saturday Delivery you must check the appropriate box during checkout. Please note: all Saturday Deliveries must be placed by Friday 12:00 PM EST.

5. No delivery to P.O. Boxes or APO/FPO: Sorry for any inconvenience!

6. Product freshness: OlmaFood.com is committed to delivering safe, fresh products. To ensure this, we are continually improving our unique packaging system. We use airtight, fully-insulated, and temperature-retaining system that keeps all contents cool. This technology retains products’ temperatures for a full 24 hours in air temperatures up to 105 degrees Fahrenheit, and for full 48 hours in air temperatures of up to 90 degrees. We proudly guarantee that all food products you receive from OlmaFood.com are just as fresh as when they left our facilities.

Our unique shipping system utilizes a reusable, seamless, molded polystyrene cooler chest, accompanied by a nontoxic refrigerant gel pack and dry ice chips. All perishable foods are temperature-controlled within the cooler, which is then encased in an outer cardboard shipping container. To further prevent any temperature escalation, we fill any remaining areas with filler to minimize any air circulation. Additionally, this cooler and refrigerant gel packs are reusable—so you may use them to your heart’s content! Please note that during the colder winter months, OlmaFood.com may use a slightly different for shipping method to colder states.

Portions of certain products may be frozen due to any potential delays in transport. Additionally, some products may be treated with a thermal treatment to preserve taste and freshness.

OlmaFood.com requests that someone be available at time of delivery to sign for and receive the package, and refrigerate any perishable products ASAP. If the package is left at the door, OlmaFood.com will not be able to take responsibility if any perishable products spoil.

To fully enjoy your gourmet products’ full range of flavor and freshness, be sure to prepare for your delivery—in advance—and have someone ready to receive the order.

7. Product pictures: Please note that the actual items may vary slightly from any pictures on our website.

8. Returns & Exchanges: All products are guaranteed to be fresh. However, they must be inspected immediately upon arrival—as credit will NOT be granted if unsatisfactory items are discarded or consumed (even partially). If you want to return any item, please keep all packaging intact. Also, all return claims must be made within 24 hrs of shipment receipt. At that time, a return authorization code will be issued. Once we receive and accept the claim, we will automatically resend the merchandise. Please note: returns will not be accepted without a return authorization code.

Please inspect all products the moment they arrive. If your shipment arrives tampered with, or otherwise damaged, please contact FedEx and our customer service department immediately. Remember that the sooner you contact FedEx and our customer service department—the easier it will be to file a claim. And also remember to keep all packing and products exactly as they arrived.

Return & Consumer Safety Policy

1 OlmaFood.com’s operational and business practices are guided by the New York Food Safety Act, the FDA and all applicable federal, state and local food safety rules and regulations.

2. OlmaFood.com is committed to protecting the public’s health, and promoting public welfare. We are firmly committed to ensuring this by doing our part to prevent injury from product use, marketing and/or merchandising deceit resulting from the interstate sale of food products.

3. OlmaFood.com uses secure, temperature- and humidity-controlled packages to ensure safe, fresh food transportation.

4. Any damage resulting in-transit (accidental, or otherwise), must be addressed with FedEx in accordance with their policies.

5. We discard all returned food. This helps prevent any risks associated with spoilage or misbranding.

6. Due to multiple federal, state, and local regulations—and for public safety, in general—all sales of any food items are FINAL SALE. No return or exchange claims will be accepted.

7. Delivery dates are approximate, only. OlmaFood.com is not liable for any delay or damage resulting due to any delay or delivery failure, for any reason, including (but not limited to) acts of God, any act of the Purchaser, embargo or governmental acts, regulation or request, sabotage, fire, flood, accident; strike, slowdown or other labor difficulties; war, riots, transportation delays, or carrier default. In the event of any delay, the delivery date will be extended for a period of time equal to the time lost because of delay. The Buyer’s ONLY remedy for OlmaFood.com’s inability to deliver for any reason shall be cancellation of this agreement, which the Buyer may only exercise before OlmaFood.com has delivered the shipment to a carrier at any shipment point.

8. This agreement and the conditions and terms contained here make up the entire agreement between OlmaFood.com and the Buyer. No portion of this agreement may be amended, waived, discharged, changed or terminated orally, but only by a written agreement signed by all parties, unless as expressly provided within this agreement.

9. This agreement, as well as all rights affected by this agreement, is governed by the laws of the State of New York (regardless of any rules or principles of conflicts of laws that might consider any jurisdiction outside of New York State). All parties irreversibly submit to the jurisdiction of—and are heard in—Federal or state court located in New York City, NY. The parties also irreversibly waive (to the full extent that each may do so), the defense of an inconvenient forum towards maintaining any resultant action in New York City, NY.

10. If any dispute arises out of, or is related to this agreement, and whether a lawsuit is brought or not, the unsuccessful party in the dispute must pay to the successful party all costs and expenses incurred by the successful party. The costs include, without limit, all reasonable attorney fees, including costs and attorney.
